Here's Hoping

Bin Laden has vowed to never be captured alive. Hopefully he has a chance to prove this soon!

All the ACLU would want is a fair trial and fair representation. As guaranteed by our Constitution.

I don't have time to go through your laundry list right now (rest assured I will in the near future), but I will say this- if you are going to try bin Laden in a U.S. court, he must be offered all the rights and protections of the U.S. Constitution.

If he were to receive a military trial, that's a horse of a different color.

Bin Laden will never stand in a US Courtroom. He will either be granted his wish or he will be executed by order of a military tribunal as soon as we are finished squeezing every ounce of information out of him if we get him first.

Southpaw...the question for you is do you believe he deserves a trial before a court? I'm sure the ACLU will fight for that...where do you stand?

I do believe he should be tried, and here is why: if we are to one day execute him because of his actions, (which we should if he is convicted) it would not mean anything unless we can show the world that we are not the barbarians that he is. He not only killed thousands of Americans, but he stands for everything America is not: intolerance, hatred, and savagery. What have we been fighting for if not to defend the American way of life (at least in Afghanistan- Iraq is more complicated)? The American way of life means a fair trial by an impartial judiciary. Might be tough to find, be we can at least try.

as far as how and where, it's a very interesting legal question, concerning jurisdiction, international law, and war crimes.

He killed U.S. citizens, and violated a number of other state and federal laws, so getting jurisdiction in a u.s. court would probably be relatively easy to do.

Trying him for war crimes before an international tribunal is also easy to see.

I do not know much at all about military courts and justice, and have no idea what is necessary to meet jurisdictional requirements.

Of course, there is nothing to keep him being tried in all three jurisdictions. Then there will be countless extradition battles, etc.

Southpaw...I'm encouraged to know you support the death penalty for Bin Laden.

If bin Laden ends up being all talk like Saddam and we find him in a chicken hole, that will be the last time in his life he sees the light of day if it is US forces that capture him.

He will not be turned over to the Hague b/c they are just a complete mockery...ie...Milosovich.

He won't stand trial in a US court b/c he is a war criminal, so he is not affored the same rights of due process, trial before peers, etc. From my understanding, a military tribunal would have jurisdiction over him and I think that has recently been upheld by the Supreme Court.

Ideally I would like him captured, but it be kept secret for as long as possible to gain more intel...then once it is out that he is captured...have the secret tribunal...then see his dead body to prove to the world he is dead.

Sorry, I'm kind of late on responding. It's been awhile since I've actually touched the computer, but I just had to respond to giving a fair trial and representation as guaranteed by our Constitution to Bin Laden. I am by far no political expert or no where near the most intelligent person to hold a debate with anyone, yet I am a mother of three. So, I ask this though our Constitution gives us so many freedoms does that mean we should give those freedoms to someone who took so many others freedoms away?
It never harmed anyone to swallow evil words, even though we have the freedom of speech. It would also seem right that though we have the right to bear arms we don't go around shooting everyone. Our Constitution is meant as a guide and should only be used by those who respect those freedoms and use their "heart" in their decisions. I'm sure it'll be commented, "well what about other criminals?" Only my opinion, but no I don't believe that criminals should have the priviledge of freedoms. I don't care what religion you are or what political views you may have - wrong is wrong. Bin Laden didn't think about how fair it was to take away a child's only father or mother, when he made his plans of terroism. He only thought of himself, so I believe for the protection of our families from future Bin Ladens - this should be a teaching moment. I strive to teach my children right from wrong and what is fair and unfair. If a child in school breaks a rule, it would be unfair that they get the same priviledges as the other children who work so hard to do well. Now this is just my belief, rip it apart if you may, but don't you think that it is unfair that a man with such hatred to kill in such a way and still want to kill be given such a right to stand a fair trial. I know what my child would say - "Mom that's not fair" Though simple and maybe naive, we can learn a lot from our children.
